Update: Right-To-Petition Lawsuit
Amended Complaint To Be Filed Shortly
Getting Serious About Freedom & WTP
New WTP Congress National Director Appointed
Thus far, almost
four thousand people have signed up to be part of the landmark lawsuit that
is asking the federal judiciary for a declaration of the meaning of the last
ten words of the First Amendment to the Constitution of the United States of
America - the unalienable Right to Petition the government for a Redress of
Grievances.
The
People claim their fundamental Right to Petition for Redress, rather than
the Right to Vote, is -- and has always been -- the only non-violent way for
the individual and the minority to hold the government accountable to the
Constitution with its guarantee of individual, unalienable Rights, both
enumerated and un-enumerated.
The
People claim their fundamental Right to Petition for Redress includes the
Right to submit a statement of grievances and a prayer for relief to
officials of any branch of the government, all based on evidence that the
government has stepped outside the boundaries drawn around the powers
delegated to it by the People through the Constitution.
The
People claim their fundamental Right to Petition for Redress includes the
Right to an honest and timely response by the government.
The
People claim their fundamental Right to Petition for Redress includes the
Right to enforce that Right, knowing that any Right that is not enforceable
is not a Right.
The
People claim their fundamental Right to Petition for Redress includes the
Right of Redress Before Taxes, that is, their Right to
Petition includes their Right to enforce that Right by retaining their
money until their grievances are redressed if the government refuses to
properly respond to their Petitions for Redress.

whether one is withholding taxes or not)
The
People claim their fundamental Right to Petition for Redress is inextricably
intertwined with, and inseparable from, their other fundamental and
individual Rights that are guaranteed by the First Amendment, including the
Rights to Peaceably Assemble, Speak and Publish freely.
The
People claim their fundamental Right to Petition for Redress (and to Redress
Before Taxes, to Peaceably Assemble, to Speak Freely and to Publish Freely)
includes full protection from retaliation by the government against those
that Petition.
The Courage Of The Named Plaintiffs
Thus
far, approximately 1500 people (of the almost
4,000 potential class-action plaintiffs) have sent us notarized
affidavits, indicating their willingness to be a “named” plaintiff. Click

As
named plaintiffs (as opposed to “class-action” plaintiffs), their names and
addresses will appear in the official caption of the case on all filings.
This means they are willing to stand as formal plaintiffs and explicitly
declare their intent to defend the Constitution, rather than participate
more modestly as a (generally) less visible member of the “class” – that is,
the group of people identified in the caption as “and all others similarly
situated.”
By
agreeing to be named plaintiffs, these individuals will not be dependent on
the willingness of the court to certify the “class” in order to be a party
to the action. “Named” plaintiffs will not have to incur the likely delays
waiting for the logistics of the legal process to “certify” the class, and
they also avoid the possibility that the judge may not certify the class at
all – leaving these potential plaintiffs without standing in this lawsuit.
As
named plaintiffs, these individuals stand a chance of benefiting more
quickly from the injunctive relief we seek – an order from the court
enjoining and restraining the IRS and the DOJ from engaging in any
enforcement action/retaliation against them. Any such order of protection
issued by the court would not apply to the unnamed members of the class
until after the court certifies the class, if at all. The court will not
address the question of class certification until after all pre-trial
motions (and any appeals) have been decided, which could take a significant
period of time.
Last Call For Affidavits
We
urge everyone who has not already done so to immediately submit a notarized
affidavit, indicating your desire to be added to the list of named
plaintiffs. Click here for a copy of the

Modify the affidavit if necessary, print the affidavit, fill it out, sign it
in front of a notary public and send it to us by priority or express mail --
ASAP.
If your affidavit is not received at our office in the next several days,
it will not be included in the Amended Complaint we are currently preparing.
IMPORTANT NOTE: It will help us to know that you intend to submit an
affidavit and what will be on the affidavit. If you want to be added to the
list of NAMED plaintiffs and will be mailing in an affidavit immediately,
please submit the data on our on-line
Final Data Form. This will help
us meet our self-imposed deadline of filing the Amended Complaint by the end
of next week.
We
know it takes courage to put your name and address on a list that is going
to the government – to stand and be counted – but, we believe it is
important that we demonstrate to the government that the People are united
by their growth in courage, in grace, in knowledge, in reputation, in our
sense of what is right and proper, and that we are developing toward
maturity as responsible defenders of our beloved Constitution and its
essential principles.

We
intend to add all verified named plaintiffs and file the amended complaint
by the end of next week.
To do this, we need full information and/or data verification from ALL
named plaintiffs:
1) If you have already submitted a lawsuit affidavit we need to CHECK the
accuracy of the information we have on file for you. We need you to verify
it by RESUBMITTING IT via our
Final Data Form page. To check

2) If you are just now joining the lawsuit as a NAMED plaintiff or
“upgrading” from the “class-action” plaintiff status, you need to fill out
and submit the Final
Data Form page AND send a notarized
affidavit
to our home office ASAP by overnight
or priority mail. If we do not have your affidavit in hand, you will not
be included in the Amended Complaint as a named plaintiff. Click here to

Again,
1) Even if your information is CORRECT, we need to hear back from ALL
current named plaintiffs affirmatively verifying the correctness of their
full contact information and 2) we need to receive ASAP like information AND
notarized affidavits from any individual wishing to become a NAMED plaintiff
at this time.

Motion For Injunctive Relief
As
soon as we file the amended complaint adding the many new named plaintiffs,
we will be moving the court for injunctive relief, requesting a restraining
order enjoining and prohibiting the government from taking any further
enforcement actions against certain named plaintiffs.
Lawsuit Awareness Tour
In
order to further the likelihood of success in our lawsuit, we must now
collectively focus on the substantial task of raising the level of knowledge
of the body politic regarding the meaning and significance of the Right to
Petition the government for Redress of grievances and about our class action
lawsuit.
We
must now act to inform many more Americans that their Right to Petition
rather than their Right to Vote is more likely to put an end to
undeclared wars like Iraq, erosion of the Bill of Rights by Acts like the
USA Patriot Act, the ill-omened national debt, and involuntary servitude by
the direct, un-apportioned tax on labor.
With
this goal, we are now scheduling a series of weekend rallies across America
that will commence in September and run through this Thanksgiving. Building
beyond our previous experiences with organizing and conducting such events,
we intend to host freedom and lawsuit relevant speakers, exhibit multi-media
presentations, provide advance publicity and media planning for each rally
and provide participants with the tools, educational materials and knowledge
needed to secure our goals.
In
short, we intend to reach still further into the homes and businesses of
America in order to raise awareness about our organization, the RTP lawsuit
and our crucial mission to restore Constitutional order – and awaken America
to join us in that battle.
In the
upcoming rallies, we will engage the People in civic education and civic
action by teaching and encouraging them to sign the Petitions for Redress of
Grievances and to RETAIN THEIR MONEY UNTIL THEIR GRIEVANCES ARE REDRESSED.
We will educate our supporters about how they can take this fight to their
own cities and neighborhoods and we’ll give them some of the tools needed to
succeed.
We
want to etch into the permanent awareness of We the People, the phrase,
“No Answers, NO TAXES.” (Again please note,
participation in the lawsuit does not depend on whether one withholds taxes
or not.)
We
want People this election cycle to be able to answer the question, “What do
the last ten words of the 1st Amendment mean?”
We
want People over and over again to hear the phrase, “It’s the Constitution,
Stupid” (to borrow from a campaign slogan from the early 90’s).
We
need to convey to People that real hope lies in “None of The Above,”
because, as Jefferson said, “All political parties are by their very nature
corruptive.”
Bob
Schulz will spend all of September, October and November chairing the
meetings.
It is expected the meetings will resume following the winter holidays.
At
each meeting hall we will provide a telephone hook up for RTP lawsuit
counsel Mark Lane to answer questions about the lawsuit or the Right to
Petition. We will have our new WTP Power Point presentation on hand
everywhere, along with an ample supply of our new WTP brochures, Petitions
For Redress, Forms for Joining the Class Action lawsuit, copies of the
Complaint and other educational literature and media-awareness offerings.
For
those who want to stage silent marches in front of federal office buildings
or in front of the district offices of local Congressmen, etc., we will
provide signs, banners and handouts.
National Director
WTP is
pleased to announce the appointment of Tim Randolph of Union City,
California as the new full-time, National Director of the We the People
Congress, Inc.
Randolph, a highly-accomplished Silicon Valley business executive comes to
the position with an established track record of personal and professional
integrity and has repeatedly demonstrated his principled commitment to
defend the Constitution. Tim has previously served WTPC for several years as
the California State Coordinator.
Tim,
who has (quoting) “put his life on hold” to take on this key position,
brings a suite of proven management and business development skills to his
new role, which will consist of initially organizing the upcoming fall WTP
lawsuit awareness meetings, building out the Congress organization, and
establishing a sound foundation for financing the ongoing operations of the
WTP Congress. Randolph will continue to function in his role as California
State Coordinator until further notice.
We
call upon all state and county coordinators, volunteers and Congress members
to give their best effort to the tasks at hand. We ask that everyone step up
to the plate and begin “swinging” for Tim, WTP and Liberty. Please contact

Closing Thoughts
We
have much to do, and as always – never enough time or resources to fully
accomplish our vision. Unless each of us takes a personal responsibility to
resist the forces allied against us, the days of our Republic are surely
numbered.
Our
organization, our groundbreaking Right-to-Petition lawsuit, and our message
of truth are among the few things still standing between freedom and
tyranny. Now is the time to support WTP with both your personal

We see a world where the unalienable, divine Rights of individuals are

We see a world that can be peacefully changed by the exercise and
enforcement of the Right to Petition.
